Terms of Use

These terms govern use of aseanx.co, the aseanx tv channel and the aseanx briefing (together, the “Service”). Use of the Service constitutes acceptance of these terms. Particulars of the operator appear in section 11.

1 · Independence

aseanx is independent. It is not affiliated with, endorsed by, or acting on behalf of the Association of Southeast Asian Nations, the ASEAN Secretariat, or any ASEAN member government or organ. “aseanx” is a coined name denoting coverage of the region. No material published on the Service is to be read as an official ASEAN publication or as an ASEAN position.

2 · Permitted use

Material published on the Service may be read, searched and shared for the user’s own business or professional purposes. Short extracts may be quoted provided they are attributed to aseanx and accompanied by a link to the source page.

3 · Prohibited use

• Republication, resale or systematic redistribution of aseanx material, in whole or in substantial part, without prior written permission.
• Scraping, crawling at volume, or extraction of content by automated means for the purpose of constructing a competing product or training a model.
• Removal or alteration of any attribution, source line, date stamp or disclosure accompanying a figure, an assessment or a clip.
• Presentation of aseanx analysis as the user’s own work, or as the position of any government or of ASEAN.
• Use of the Service unlawfully, or in any manner that interferes with the Service or with its use by others.

4 · Intellectual property

The aseanx name, wordmark, design system, methodology, written analysis, MERIDIAN assessments, the Business Conditions Index and all channel material are owned by or licensed to the operator.

Third-party material is separate. Where material from a primary source is quoted, linked to or reproduced, that material remains the property of its owner and is used for the purposes of reporting and comment. Footage, imagery and music used on the channel are licensed from their providers and credited where the licence so requires. Synthetic voice and generated imagery are disclosed on screen where used.

5 · Third-party links

The Service aggregates and links to primary sources. The operator does not control those sites, accepts no responsibility for their content or for their handling of personal data, and a link does not constitute an endorsement.

6 · Enquiries and submissions

Material submitted through the enquiry form or by electronic mail is handled in accordance with the Privacy Policy. Confidential or price-sensitive information should not be submitted unless its receipt has been agreed in writing.

7 · Availability

No warranty is given that the Service will be available, uninterrupted or free from error. Data feeds are supplied by third parties and may fail, lag or be withdrawn. Any part of the Service may be changed, suspended or withdrawn at any time.

8 · Exclusion of warranties and limitation of liability

The Service is provided on an “as is” basis. To the fullest extent permitted by law, all warranties, whether express or implied, are excluded, including as to accuracy, completeness, fitness for a particular purpose and non-infringement.

The operator is not liable for any loss arising from reliance on aseanx material, including loss of profit, loss of opportunity, or any indirect or consequential loss. Nothing in these terms limits any liability that cannot lawfully be limited, including liability for fraud or for death or personal injury caused by negligence.

These terms are to be read together with the Disclaimer, which sets out the nature and limits of aseanx analysis.

9 · Corrections

Any person who considers a published figure, statement or assessment to be inaccurate may write to hello@aseanx.co. Every figure carries the source that issued it and the date on which it was observed, and correction requests are assessed against that record.

10 · Governing law and amendment

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction in respect of any dispute arising out of or in connection with them or with the Service.

These terms may be amended. The effective date stated at the head of this page indicates the version in force. Continued use of the Service following amendment constitutes acceptance of the amended terms.

11 · Operator particulars

The Service is operated by JK International Sdn Bhd (Company No. 200401009993), a company incorporated in Malaysia. The expressions “the operator”, “we”, “us” and “aseanx” refer to that company.
